Lucius AI — Terms and Conditions

1. Who We Are
These Terms are between you and Testing Mavens LLC ("Company," "we," "us"), a New Jersey limited liability company, located at 371 Hoes Lane, Suite 200, Piscataway, NJ 08854. Testing Mavens LLC operates the Lucius AI service (the "Service"), available at www.luciustest.ai. You can reach us at legal@testingmavens.com.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share information in connection with the Service.
2. What Lucius AI Does
Lucius AI is an AI-powered testing agent. You describe a scenario in plain language, or record actions in your application, and Lucius generates executable Playwright test code. You can run generated tests against your own environments — including staging, production, or private/internal environments reached through our secure Tunnel feature — edit the generated code directly, and sync it to your own Git repository.
Lucius is a functional/UI testing tool. It does not perform security penetration testing or vulnerability scanning, and nothing in the Service should be treated as a security assessment.
3. Eligibility and Accounts
- You must be at least 18 years old to use the Service.
- You are responsible for your account credentials and for all activity under your account.
- The Service is available to both individual users and organizations. If you use the Service on behalf of a company, you confirm you have authority to bind that company to these Terms.
If you are a consumer in a jurisdiction that grants you non-waivable statutory rights (for example, under EU, UK, or Australian consumer protection law), nothing in these Terms limits those rights, even where another provision of these Terms would otherwise do so.
4. Authorized Testing — Your Responsibility
This section matters most if you use Tunnel or point the Service at production systems.
You represent and warrant that for every application, URL, environment, or system you direct the Service to interact with — including through Tunnel — you either own that system or have the necessary authorization from its owner to test it. You will not use the Service to access, test, or interact with any system you are not authorized to test.
You are solely responsible for any data — including end-user personal information — that becomes visible to the Service as a result of the environments you choose to test, including production environments. We recommend using synthetic or de-identified test data wherever practical, particularly if you test against production.
5. AI-Generated Tests and Content
Ownership
As between you and us, you own the scenarios, prompts, and recordings you provide ("Input") and the test code, reports, and other output the Service generates for you ("Output"), subject to your compliance with these Terms. Output may not be unique to you — similar Input from different users may produce similar Output.
No Guarantee Tests Are Complete or Accurate
AI-generated tests, like any tests, can be wrong. The Service may fail to catch a real defect (a false negative) or flag something that is not actually a problem (a false positive). Passing tests generated by the Service is not a guarantee that your software is free of bugs, secure, or ready to release. You are solely responsible for reviewing generated tests, for your own quality and security processes, and for all decisions about whether to ship your software.
AI Training
We do not use your Input, Output, recordings, or repository content to improve our system or AI agents by default. If you choose to opt in by enabling this setting in your account, you can support us in improving the performance, reliability, and capabilities of our system and agents. This is off by default. You can enable or disable this option at any time in your account settings.
6. Git Sync, Credentials, and Your Code
If you connect a Git provider, you authorize us to access, read, and write to the repositories you select, solely to provide the Service (for example, to sync generated test code). You control which repositories are connected and can disconnect at any time.
Do not embed real passwords, API keys, tokens, or other live credentials directly into recorded test steps. Use the parameterization features provided in the Service to reference credentials instead of hardcoding them. We are not responsible for exposure of credentials you embed directly into test content.
7. Plans, Fees, and Billing
The Service currently offers a Free plan. Additional usage, seats, or features are arranged directly with our sales team on custom terms; we do not currently publish self-serve paid plans.
- The Free plan is subject to usage limits described to you at signup or in-product. We may change these limits prospectively.
- If any plan includes usage credits, unused credits roll over for as long as your account remains active on that plan.
- Refunds, where a paid arrangement exists, are considered case-by-case at our discretion, except where a refund is required by applicable law.
If you sign a separate order form or agreement with us (for example, an Enterprise agreement), that agreement controls over these Terms to the extent the two conflict.
8. Beta and Preview Features
We may label some features "beta," "preview," or similar. These are provided as-is, may be changed or withdrawn at any time, and may not work as reliably as generally-available features. We are not liable for issues arising from your use of beta or preview features.
9. Prohibited Uses
You agree not to:
- Use the Service to test, access, or interact with any system you do not own or are not authorized to test.
- Use the Service to build, train, or improve a product that competes with Lucius AI.
- Attempt to bypass safety filters, rate limits, or access controls in the Service.
- Systematically scrape or harvest data from the Service outside normal use.
- Upload malicious code, or use the Service to attack, disrupt, or gain unauthorized access to any system.
- Misrepresent your identity or impersonate another person or organization.
10. Third-Party Services
The Service relies on third-party providers to operate — including cloud hosting, AI/LLM providers, and Git hosting providers you choose to connect. Your use of those third-party services (where applicable, e.g. your own GitHub account) is also subject to their terms.
11. Intellectual Property
We own the Service itself, including its software, design, and branding. Subject to your rights in your own Input and Output under Section 5, we grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
12. Term and Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, or if required by law. Upon termination, your right to use the Service ends; provisions that by their nature should survive (for example, ownership, disclaimers, liability limits, and dispute resolution) will survive.
13. Abuse and Misuse of the Service
We may block, restrict, suspend, or terminate your access to the Service, with or without prior notice, if we reasonably determine that you are abusing the Service, using it for purposes other than legitimate software testing, or using it in a manner that is inconsistent with the intended purpose of the Service. This includes, without limitation, using the Service to conduct unauthorized activity, circumvent Service limitations or controls, systematically extract or misuse Service resources, or otherwise interfere with the Service or its intended operation. Where reasonably practicable, we may provide notice and an opportunity to remedy the violation before taking action.
14. Disclaimers
THE SERVICE, INCLUDING ALL AI-GENERATED OUTPUT, IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, INCLUDING ANY WARRANTY THAT OUTPUT IS ACCURATE, COMPLETE, OR FIT FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SERVICE WILL DETECT ALL DEFECTS, BUGS, OR SECURITY ISSUES IN YOUR SOFTWARE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including certain protections for consumers.
16. Indemnification
You agree to defend and indemnify us against claims arising from your breach of these Terms, your unauthorized testing of systems you do not control, or your misuse of the Service.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules.
Any dispute will be resolved by binding arbitration under the American Arbitration Association's Commercial Arbitration Rules, seated in Piscataway, New Jersey. You and we each waive the right to a jury trial and to bring or participate in a class action.
You may opt out of this arbitration agreement by emailing us within 30 days of first agreeing to these Terms. If you opt out, disputes will be resolved in the courts located in Middlesex County, New Jersey.
If you are a consumer with non-waivable rights to bring claims in your local courts or through a local ombudsman or regulator, this section does not remove those rights.
18. Export Controls
You may not use the Service in violation of applicable export control or economic sanctions laws, and you represent that you are not located in, or a resident of, any country or region subject to comprehensive US sanctions, and are not on any restricted-party list.
19. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide reasonable advance notice (for example, by email or an in-product notice). Continued use after changes take effect means you accept the updated Terms.
